What do the Texas DMV advertising rules require?

Anyone in the business of buying, selling or exchanging motor vehicles needs a general distinguishing number (GDN) from the Texas Department of Motor Vehicles, and a dealer selling new vehicles also needs a franchised dealer license. The department's advertising rules are in Title 43 of the Texas Administrative Code, Chapter 215, Subchapter F. Two sections shape a dealer website.

Section 215.250, dealer price advertising:

  • The featured sales price must include destination and dealer preparation charges and any additional dealership markup.
  • Only taxes, registration, title and license fees, and other fees expressly allowed by law may be left out.
  • The price cannot be qualified with phrases such as "with trade", "with dealer-arranged financing" or "with down payment".
  • Advertising an "internet price", "e-price" or a similar term is prohibited.
  • A savings claim or discount offer is allowed only for a new vehicle.

Section 215.251, identification: an ad with a sales price must state the model year, make, model and whether the vehicle is used or a demonstrator. A photo must be of the advertised vehicle or one substantially the same.

How do the documentary fee and sales tax work in Texas?

The Office of Consumer Credit Commissioner (OCCC) sets the documentary fee rule for financed sales. A fee of $225 or less carries no extra requirement. To charge more, a dealer must send the OCCC a cost analysis showing the fee is reasonable. The OCCC released draft changes for comment in May 2026.

The Texas Comptroller states the motor vehicle sales tax as 6.25 percent of the sales price, minus any trade-in allowance. The rate is the same in every county. A new resident bringing in a vehicle already registered in their name pays a $90 new resident tax in place of use tax.
