Who regulates Utah dealers, and what does the ad rule require?

The Motor Vehicle Enforcement Division, known as MVED, issues and renews dealer and salesperson licenses and investigates vehicle-related crimes. It sits under the Utah State Tax Commission. Its advertising rule is Utah Administrative Code R877-23V-7.

  • Say "used" first. An ad for a used vehicle must carry the term "used," "pre-owned," "certified used," "certified pre-owned" or a similar term in its opening line.
  • Put a branded title next to the vehicle name. If the vehicle has a branded title or salvage certificate, the ad must say so right after the year, make and model.
  • Price in the required charges. An advertised price must include freight, destination, dealer preparation, dealer handling and any item that is not optional. Taxes and the dealer documentary service fee may be left out.
  • Never write "cost." "Invoice" may be used only if you will show the buyer the factory invoice.
  • No fine print. A qualifying statement cannot be smaller than the body text.

The first two points are title-tag decisions. A page title that buries "used" also misses the word buyers type. Check the current rule and ask MVED where an online listing's "opening line" begins.

How does Utah handle doc fees?

Utah Administrative Code R877-23V-14 sets no cap on the fee in the text we read. It requires a sign instead. A dealer that charges the fee must post a sign in the sales area that states the dollar amount and says the fee is not set or mandated by statute or rule.

Online, state your fee, call it a dealer fee, and never describe it as a state charge.

Why does a Utah dealer's address change the buyer's tax?

Publication 5 says the sales tax rate on a vehicle bought from a dealer is based on the dealer's location. On a private sale it follows the buyer's address. A trade-in allowance may be excluded from the amount taxed.

What replaces the inspection visit in the service lane?

The Utah Division of Motor Vehicles says most vehicles have needed no safety inspection for registration since January 1, 2018. Emissions tests are required in five counties: Salt Lake, Davis, Utah, Weber and Cache.

Provo barely exists as a search term. Buyers there appear to use a wider phrase: "used cars utah" gets about 800 searches a month. A Provo dealer should build for statewide and near-me searches as well as the city name.

St. George is the reverse: far more city-named searches than Provo, and a lower combined tax rate that a dealer can state as fact.

What should a Utah dealer check this month?

  1. Does every used vehicle listing open with "used" or a similar term?
  2. Are branded and salvage titles named right after the year, make and model?
  3. Do advertised prices include freight, destination, prep and handling?
  4. Is the doc fee shown as a dealer fee, with the amount, and never as a state fee?
  5. Does your tax page give the current combined rate for your lot's city?
