What does Washington law require in a dealer ad?

The Department of Licensing licenses vehicle dealers. The advertising law is RCW 46.70.180, which makes false, deceptive or misleading vehicle advertising an unlawful practice, and the department's rule WAC 308-66-152 fills in the detail. Build these in from the start:

  1. The doc fee line. RCW 46.70.180(2) lets a dealer charge a documentary service fee of up to $200 per sale or lease. Dealers must disclose in any advertisement that a documentary service fee in an amount up to $200 may be added to the sale price or the capitalized cost.
  2. "Negotiable," in writing. Before the agreement is signed, the dealer must disclose in writing that the fee is negotiable, in type at least as large as the standard text and set off so it stands out. A dealer may not say the state requires the fee.
  3. Who is advertising. Under WAC 308-66-152, an ad must identify the dealer by its complete business name, or by the word "dealer" or the abbreviation "DLR".
  4. How many at that price. The same rule calls for the number of vehicles available at an advertised price, identified by VIN or license plate, unless supply is unlimited for immediate delivery.
  5. Recent used vehicles. A vehicle built fewer than two years earlier must be labeled "used," "demo" or "demonstrator" when it is not new.
