What does Washington law require of health care marketing?

Two laws apply. The Uniform Disciplinary Act covers what an ad says. The My Health My Data Act covers how you collect data and target ads.

Three Washington laws affecting medical marketing: misleading advertising, consent for health data, and the geofence ban
LawWhat it saysWhere it shows up in marketing
RCW 18.130.180(3)All advertising which is false, fraudulent, or misleading is unprofessional conductEvery page and ad
RCW 18.130.180(16)Promotion for personal gain of any unnecessary or inefficacious drug, device, treatment, procedure, or serviceElective and cosmetic service pages
RCW 19.373.030Consent before collecting consumer health data, and separate consent before sharing it, unless needed to provide a requested service. In effect since March 31, 2024, and June 30, 2024 for small businessesTracking pixels, ad platform audiences, form tools
RCW 19.373.010Consumer health data includes precise location tied to health services and health inferences drawn from other dataRetargeting people who viewed a condition page
RCW 19.373.080Unlawful to geofence an in-person health care facility, within 2,000 feet, to identify or track people seeking care, collect their health data, or send them health-related adsLocation-based ad campaigns

Check every tracking tag on the site. A pixel that tells an ad platform someone visited your page on a specific condition is sharing a health inference. Under this law that needs separate consent. Ask whoever manages your site for a list of every tag and what it sends.

Do not buy geofenced ads around clinics. Targeting phones near a competitor's office or a hospital is a tactic some agencies sell. In Washington it is unlawful within 2,000 feet of a health care facility when used to send health-related ads.

Local SEO does not depend on any of this. Ranking on the map comes from your Business Profile, reviews, and pages. None of it requires collecting visitor health data. That makes it the low-risk channel for a Washington practice.

Review replies. In June 2023 the federal Office for Civil Rights announced a $30,000 settlement with a New Jersey practice over patient details in replies to Google reviews. A reply must never confirm that the reviewer is a patient.

A state privacy law that requires consent before collecting consumer health data and separate consent before sharing it. It has applied since March 31, 2024, and since June 30, 2024 for small businesses.

Can a Washington practice run geofenced ads near a clinic?

Not to send health-related ads. The law bans geofencing within 2,000 feet of an in-person health care facility for that purpose.

Does the privacy law affect local SEO?
